The NSW Government is undertaking a review of the Roads Act 1993 (the Act) to create a more contemporary planning and management framework for roads and streets across NSW.
This review aims to better enable Transport for NSW and councils as decision makers and recognises the function of roads not only for vehicle traffic but for all road users.
Have your say on the Roads Act 1993
The Roads Act 1993 (the Act) guides the creation, regulation and protection of our roads in NSW. Much has changed in the more than 30 years since the Act was introduced, the NSW Government is now reviewing the Act to ensure it remains fit-for-purpose.
Transport for NSW is calling on local government, industry and other stakeholders to take part in this once-in-a-generation review to help modernise the Act so it continues to serve NSW now and into the future.
To commence the review of the Act, Transport published an Issues Paper to specify what is in-scope for the review and highlight the current underlying challenges experienced under the Act.

The NSW Government has set four targeted objectives for improvement. They are ensuring:
- More contemporary uses for roads and streets that are safe and responsive to community needs.
- Faster local decision making with appropriate mitigations to manage network risk.
- A streamlined and easy to use statute that keeps pace with change.
- A more operationally effective statute.
