National Construction Code 2025 Update – Tasmania

CBOS has recently contacted stakeholders to advise of recent developments regarding the application of the National Construction Code (NCC) in Tasmania.

 

Building Amendment Bill 2026

The Building Amendment Bill 2026 has now passed both Houses of Parliament with amendments. Once the Bill receives Royal Assent and commences, it will pause the operation of NCC 2025 in Tasmania. Commencement is anticipated in the coming weeks.

This means that:

  • NCC 2022 will again apply in Tasmania once the amendments come into force; and
  • NCC 2022 will remain the applicable code until 1 May 2027, at which time Tasmania will adopt NCC 2025.

 

Current status of the NCC in Tasmania

As NCC 2025 commenced on 1 May 2026, it currently applies to new building and plumbing designs.  

A project that has been granted building approval must be completed in accordance with the edition of the NCC that was applied at the time that approval was issued. This means that if a project was approved under NCC 2025, then NCC 2025 will continue to apply to the project.

 

Transitional Provisions

Section 11(5) of the Building Act 2016 sets out a range of circumstances where a provision of the NCC is not applicable.  Further information on the application of Section 11(5) is available on the CBOS website.

 

Effect of the amendments

Once the Building Amendment Act commences:

  • NCC 2025 will no longer apply in Tasmania (subject to any transitional arrangements that may be prescribed); and
  • NCC 2022 will be reinstated as the applicable code for building and plumbing work until 1 May 2027.
